Tight waistband, can't wear it

I read the size chart and even went up a size thinking the unisex fit would help it fit correctly. But the band on the waist is so tight it's uncomfortable to wear and I needed help getting it off to be able to put it back in the bag to try to return. Reached out to customer service about it and haven't heard back yet after almost a week....
